Agreed, even been nailed by a snowball that had a rock in it? Pretty much the same. Only difference is the malicious intent

We're still just talking about WORDS. It's semantics to talk about milkshakes or bricks or slurs. They are all still JUST WORDS. Words are not actions. Words are not a crime. At least, not in my country.

We aren't talking about just words when it comes to incitement. Calling someone names? Legal. Laughing at assault? Legal. Calling for people to continue to engage in assault? That's incitement, and it's not legal.

No it isn't illegal actually. Even yelling "fire" in a crowded theater has been deemed legal and free speech. Incitement has to be proven as both *imminent* and *likely*. These are WORDS on the internet between people hundreds or thousands of miles away from each other.

Except it is illegal. It's literally a call for violence. This is telling people to take violent action. There is every reason for someone of influence to believe that will cause at least some people in their support base will go out and do it. Incitement is illegal.

It has to be both imminent and likely. It doesn't pass on either count.

It passes as both. You cannot tell me that someone calling for action, because that is exactly what it was, isn't likely to get someone to go out and do it, when they have the following this guy does. You cannot tell me it also isn't imminent when it's been happening already.

No and no. It doesn't pass the Brandenburg test.

Literally yes and yes. If someone has a large following and tells that entire audience to go commit assault, then there's reason to believe someone will. And when those instances of assault under those specific conditions are already happening? It's imminent. No two ways here.

Those are different scenarios. This article is about defamation, not entitlement.
