That assumes they are mentally "sane" as you say. If they are not, then it may be their fault but how one treats them / prosecutes them will be different. The for-profit prison system is too expensive to deal with a "lock em up" mentality, which has proven not to be effective.

Definitely not a needle. If killing is wrong, then it's wrong and we can't justify it by the state in our name. May be he deserves life, if found guilty and what the circumstances, we'll see. If he is not mentally ill, then he is rational and we can find out why he did it.
