They've been killed IN COMBAT, ON THE BATTLEFIELD. That's WAR, not a war crime (nor a crime of ANY sort).
It's open to interpretation, partisanship, and debate, because the law on this is not yet codified.

International law is only 'codified' when it's established by treaty. Customary international law--established by precedent--IS STILL LAW.
