You're misunderstanding what James said. He never claimed there was nothing wrong with grabbing butts, just that to place them in the same category as, say, breaking someone's nose, was unreasonable and a legal can of worms.

I would never grab a woman's butt without consent, because it's an infringement of her freedom. But I wouldn't consider grabbing her butt equal in severity to beating her butt with a baseball bat. Capiche?

As stated before, the definition of 'assault' does not take into account severity. Severity is determined by type of assault.

I think this is a problem in itself - people often don't consider such nuances. Imagine you walk past a girl in a busy bar, and it's so crammed that your hand brushes her butt. She then thinks you've assaulted her, and you're bracketed in with someone who beat someone into a coma

In such cases, people aren't going to say, "oh, well, it was assault, but not aggravated assault". They're only going to say, "it was assault".
