I figured out the band was in the live stream for about 2 minutes, but was not used in full and was in the background of the video. It consituted under fair use.

works that create new meaning for the source material are considered fair use. your problem is, you didn't create new meaning for the source material that you used in your video. you just used the source material in your own video and are monetizing it. you're boned.

I was dancing with someone with the camera on me only & with the song in the background and this was during an hour parody livestream of me walking around the convention,, the video was also not monetized and the song wasn't used in full.

Would you post a video of you dancing to any top 40 single right now and expect it to go un-striked? Of course not. This is the same situation. Edit your video to remove his music and re-upload it. Simple solution to a simple problem. Stop creating stupid drama.
