So why does and how can the SEC assume that investors - or anyone - would make investment desicions based on Tweets which could easily have been either "just Tweets" or in error or fradulaent in some way e.g. a hacker !?! JW.

Because it can be deemed stock manipulation. People have been sentenced for it for less than that. It's especially sensitive when you are the president of the company.

Thanks for your helpful observation. I'll follow the story. I feel there is a rather vindictive / condemnation trend in the World today e.g. somebody makes comment "X" and therefore "X" has to define them 100% and always !?! JW.

You are just now noticing that todays hero is tomorrow's goat? Musk has always been just on the sunny side of grey, peddling what people hope is true. The big flaw was when he set a deadline for actually making X number of cars at X price. Couldn't do it. As per prediction.
