There's an interesting correlation between peoples' perceptions of Fair Use and YouTube's Content ID.

In essence Content ID is being viewed as the arbiter of Fair Use: if it gets through the system it's in the clear.

This is, of course, not true, but it's the way that a lot of people are mentally framing the issue.

The other fallacious common ideas are that "if it's in a review it counts" and "if I'm critical of it it counts"

A good example of this is the us of reaction clips like Raul Julia's M. Bison, "not the bees!" &c. to make a joke in a review.

Another example would be the "call and response" video where skull-faced YouTubers play an entire video and pause to make comments.

@FoldableHuman I started to write a long blog post about YouTube, and Content ID and Fair Use. I didn't finish.

@FoldableHuman Although companies making use of Content ID should adopt policies that respect the principles of fair use.

"LOL, this includes stuff on your own site!" Uh, yeah, it's almost like this gives me a familiarity with the issue.

It's a shame, but Otter Ideas (S3E3) will likely need to go away with the move to YouTube. It doesn't pass Fair Use. http://blip.tv/foldablehuman/s3e3-april-fool-s-6561850 …
