The second point is that if you are going to bend over backwards to say that hate crime legislation shouldn't exist despite the myriad of reasons it needs to, you might want to take a look in the fucking mirror as to why and get real with yourself.

It’s not entirely accurate to say motive differentiates. It’s intent, and even then not so much. You can not intend to kill and still be convicted of murder (“depraved heart”) and you can intend to kill and get manslaughter (“provoked/excused homicide”)

Which is to say WHY you wanted to kill someone is relevant to the murder/manslaughter distinction sometimes, but doesn’t decide between types of murder (semi-accurate for CA but your state may vary on this). In general intent matters and motive doesn’t.
