If Trump didn't discuss his opposition to the Russian investigation with Sessions it would've been easy for Sessions to just say so.

Trump is calling Congress's bluff, assuming that it won't hold anyone in contempt, sparing him the cost of claiming executive privilege.
If Mr. Trump claims that privilege, it should be challenged as a likely effort to protect potentially illegal activities.

Sessions implied that exec. privilege has to be waived. Meaning Trump, by refusing to waive, HAS de facto asserted it.
