Is it up to judge to let him free? Is it standard practice? All of us poor people get stuck in jail, even before we get convicted.

I'm not sure it's just what I read. And he also filed to get rid of the judge too. Most people can't even afford a lawyer let alone delay sentencing and try to get a new judge after sentencing, a sentence that was reduced by the DOJ.
