Murder 1 isn't the highest they coule have gone. Capital Murder is a higher offense, and terrorism-related acts do qualify. But Virginia's definition of terrorism is very narrow.

Reportedly there are efforts to charge anyone involved in a protest with crimes committed by any other protesters. How would that work if one of your co-protesters committed murder in the 1st degree?

That I don’t know. I just remember a reference to trying to pass a law to the effect that if say somebody breaks a window, everybody there can be charged for it.

Except an upcharge doesn’t mean guilt. Going to be much tougher for prosecution to prove a 1st degree charge.
