The legal community needs to stop fetishizing defending Nazi speech until it starts consistently showing up for marginalized folks' speech.

When I was straight-up banned from a business for being trans, the ACLU told me it only takes cases with impact potential.

But Nazi speech defense is a settled issue, legally speaking. There is no impact potential for defending Milo.

So why not let the lawfirm of Dirtbag & Fashy LLC handle it? Because the legal community gets off on Nazi shit.

It allows them to feel like they're making a deeply painful yet morally principled stand.

Meanwhile, no one is showing up to help trans folks fight insurance denials.

I have a lot of trouble understanding the ACLU's priorities. You can't prioritize defending everyone's free speech. Why do this?

My best guess is that they're trying to deflect the "ACLU is leftist" by being assholes.

Oh no, neither do I. But I think it's a common claim that's lobbed in their direction by conservatives when they disagree with the ACLU.

In my experience, ACLU fights speech restrictions w/o focusing on impact, while impact matters when deciding to take other types of cases.

Baffled @ACLU defending #British Milo who admits to being at a party where children were raped & didn't report it? https://www.youtube.com/watch?v=oJhHwspZGcg …

Free speech vs bus ads isn't settled. There's a circuit split right now; good chance of SCOTUS. And ACLU got their own ad banned too.

ACLU would still be taking this case w/o Milo. He's a hanger-on, not the impetus. They're simply principled enough to include him.

The thing is though, the Milo thing is REALLY egregious here on WMATA's part. With multiple plaintiffs, there's no reason not to add him.
