I would remove hate speech and invocations of violence from its protections, but not criminalize them.

No... just no need to protect them in a public park.

Who gets to define what is hate speech though? The current people in power seem less than ideal for that job.

That doesn't mean we have to make it harder. Take a look at a bunch of undemocratic states, their ability to suppress speech doesn't help.

But to your less general point: I'm from Germany and our law against hatespeech is working quite fine, though it depends on competent courts

No, for the most part they won't. They'll keep the discussions private, cover the phone with a pillow in case the KGB is listening.

Is the current US conception of free speech the best one? Probably not. But it has evolved before and will hopefully do so again.
