The rule is being sent back to the Dept of Health and Human Services for re-interpretation. It was open for comment last year.

On December 31, a federal judge in Texas enjoined that rule the day before it took effect.

Today the DOJ said, "nop, sorry, sending it back to get re-interpreted." Like Title IX and GG v. Gloucester, this affects every case.

What DOJ/HHS is doing is disgraceful but statute & reg are both still enforceable in private litigation. ACLU et al will continue to enforce

I'm not gonna lie that I don't have a lot of hope that the practicalities are served by private litigation.
