LRTx2 @dominicholden: A thing here is that there is a circuit split on whether Title IX covers transgender people under "sex discrimination"

To clarify after some help from @dominicholden: There's circuit splits on Title VII trans inclusion, only district court splits on Title IX.

I am not qualified to comment on whether, or why, Title VII is different from Title IX.

@mcclure111 Loosely, Title VII is employment, Title IX is education

@EmilyGorcenski Yeah. But are they different with regard to the definition of "sex"?

@mcclure111 In principle, they can be. Recently, they've been consistent. Title VII may be more trans-inclusive so far.

@mcclure111 EEOC has recently granted right-to-sue on Title VII basis for trans healthcare discrimination: https://bringmethenews.files.wordpress.com/2016/01/lawsuit-gender-reassignment.pdf …

@EmilyGorcenski *nodnod* and something analagous for title ix, i believe, hence the lawsuit.

@mcclure111 Yeah, it gets a little more complicated, b/c one of the EEOC's roles is to basically gatekeep lawsuits like this.
