The Dark Horse Comics drama is so intriguing to me. I'm not defending them. But I get the impression y'all have NO IDEA how common blanket trans exclusions are in small group plans.

It's fucked up because trans healthcare isn't really that costly. And it's fucked up because trans people have a right to medical coverage. But this is a story that is common across 20,000+ small businesses in the US. Why are we going after one business, but not the system?

Emily, I have a question. When you say small group plans have trans exclusions, do you mean they exclude (some or all) services related to gender reassignment? (Please forgive me if that’s not an appropriate term—it’s one I’ve heard used). Or that the plans exclude trans people?

The plans exclude transition-related coverage. In practice, this amounts to excluding trans people entirely, as doctors routinely deny care to trans patients, and often times trans patients are denied the services they need on the basis of gender, e.g. prostate screenings.

Thanks. Do you know whether any legal challenges have been brought against these practices? I understand that services can lawfully be denied if determined not to be “medically necessary,” but this seems problematic, to say the least. Sorry, I am not familiar with this issue.
