2016 referendum: the High Court confirmed that the result was not legally binding, owing to the constitutional principles of parliamentary sovereignty and representative democracy, and the legislation authorising the referendum did not contain clear words to the contrary.

Gina did go to court back then to secure parliamentary involvement in the A50 process. As for a 2nd referendum if the PM gets no deal "done" in the next week or so it seems quite likely. Though who knows anything these days
