I disagree, Kevin, progressive judicial activism is a relevant problem, as you yourself pointed out when you complained of it "in the 1920s," and it's quite possibly at the heart of this apparent disagreement.

It was because it was the progessive judges who pushed the concept of Incorporation Doctrine as a means to centralize power in DC. What your are advocating no one believed in for roughly 60 years after the passage of 14A.

It was the founding fathers who set up the amendment process for the Constitution and required ratification by the states to amend that Constitution in any way, the Founders, not progressive judges, established incorporation. You need to read more of the Constitution.
