Specifically, it's cases in which there could be specific precident set. It would come down to what precident could be set, how strong the case would be, etc.

Regardless, my question had nothing to do with that (it was a deflection of the actual issue) and the copyright system in place favors the claimant over the creator. Point is, YouTube does in fact not care about Fair Use.

Don't get me wrong, there is a problem with Fair Use protection as related to Youtube, but part of this is also beyond Youtube's control, and has to do with the Doctorine itself. Again, Fair Use is a Defense Doctorine, it's not a law. It would make sense for review.......

But, the details of the 4 aspects of fair use, and whether or not the review falls into that doctorine, is something that CAN be debated in cases. And hence the dilemma.
