The Mississippi Supreme Court today upheld the 12 year sentence saying it was not so disproportionate to the crime as to be a violation of the 8th amendment prohibition on cruel and unusual punishment.

This, despite one of the judges (who voted to uphold the sentence) finding it was probable that the jail’s booking procedure was not followed, which is why he had the cell with him; and that Nash’s behavior indicated that he was not aware that he could not have the phone in jail.

A critical piece to understanding what is happening in Mississippi prisons like Parchman is that the state has some of the harshest sentencing laws in the nation and the third-highest incarceration rate in the country behind Oklahoma and Louisiana.https://theappeal.org/for-many-prisoners-mississippis-habitual-offender-laws-are-like-death-sentences/ …

I do want to emphasize this sort of sentence is NOT extraordinary nor unique to Mississippi. People get convicted of stealing soap or clothes (charged as burglary) in New York and can serve 12 years in prison. This is how we have 2.3 million people incarcerated in this country.

I should also note that in upholding Mr. Nash's sentence, the MS Supreme Court referred to two other cases where people had received 15 year sentences for possessing cell phones in jail. (Mr. Nash's trial judge had said he should "consider himself fortunate" he only got 12.)pic.twitter.com/rEJBEpFnbK

The US legal system is a nightmare worse than anything in recorded human history. That multiple, over-educated buffoons costumed in black-robes meditated over this sentence & pronounced it affirmed, only clarifies that American civil institutions have collapsed beyond repair

I disagree. The US system of slavery was a worse nightmare, and is also part of recorded human history. This leads to the conclusion that American civil institutions have always been awful for those without privilege. Rather than "collapsed," they haven't improved.

This is why we are deathly afraid of the police. I have been robbed and I would take my chances being robbed again rather then ever have handcuffs placed on me. Innocence is not a defense in this country. Our lives mean very little.

This is tragic

Let us be clear, the cell phone had nothing to do with his sentence. The color of his skin is why he was sentenced to 12 years!

This was my first thought when I read this.
