  6. I get this! Kennedy is a monster. He also sided with the majority on Mass v EPA, the ruling that gives the EPA authority and mandate to regulate carbon, which his successor will almost definitely help overturn

  7. In Massachusetts v. EPA, the most consequential ruling on climate change in the past two decades, Justice Kennedy was the swing vote. With Kennedy's retirement, the federal government's ability to regulate greenhouse gases as pollutants is now in serious jeopardy.
