Often investigators barely review the data. I’ve seen countless trials delayed because there just aren’t the resources to properly investigate the phone records and one examples where vital evidence was discovered mid-trial. They had the material but just hadn’t reviewed it.

Shouldn’t it be the accused’s phone that is handed over?

No it's not. It's about justice and truth. Stop lying to the public.

Um, you do know that some victims have had incriminating evidence found on their phones and criminal proceedings subsequently dismissed? Do keep up!

They are not 'victims' unless the defendant is guilty. Sometimes, the complainant is lying. Convicting and incarcerating the innocent is not justice. Whatever the alleged crime, whoever the suspect: justice must protect the innocent, not just punish the guilty.
