Only because Congress declines to act so often.

Absolutely in many if not all cases. But when Congress does act it can be appealed to the Courts. When the Courts act they can only be appealed to another court. Same for Executive.

Yes, but the checks & balances work, unless one side declines to check - & Congress declining to act on so much legislation cedes power to the courts & the executive
