While the nominees have been beyond solid, I think Trump should nominate folks like Kannon Shanmugam, Neomi Rao and other FedSoc minorities. I think the Admin has been fair regarding diversity but we have some home run picks that are young and diverse. Good optics for Trump.

No on Neomi Rao. The Senate doesn’t have enough floor time as it is to confirm nominees, let alone confirm her to the bench and then a replacement at OIRA.

I'm fine with either. To be frank, I'd be fine with leaving the OIRA position empty if it means putting Rao on the D.C. circuit for a lifetime appointment.

Yes, and Thomas Griffith should declare his intent to go senior the earliest he can so the Senate can confirm a replacement this year.

I think Henderson is going to go senior. Griffith is still pretty young. Word on the street is that Chief Judge Garland may retire and become president of Harvard (I read that on Above the Law)
