Fantastic piece, David. It was probably too-in-the-weeds for a NYT piece, but isn't it still correct that a Republican senator pretty much has veto power over any appellate appointment allocated to his or her state?

David, a little bit off topic, but today's hearing on Ryan Bounds brought up something interesting. In 2013-14 the Obama WH took an ID 9th Circuit seat and gave it to CA's John Owens. Could 1 of the 3 CA seats currently vacant go to Idaho to make up for what happened?

Agreed. An extra-constitutional practice that served its purpose in much different time, that devolved into an unwarranted Senatorial perk. It might have been defended as ensuring against extremist candidates, but they weren't used responsibly so they're better off gone.
