Since they are all judges enforcing the same laws, why should they have an adversarial mindset. And why should you?

You're absolutely right; I'm just being a realist and a descriptivist. Judges have strong intellectual and jurisprudential disagreements over how those laws should be interpreted, and when they clash, it can be like combat.
