Maybe they could trade the Reinhardt seat for getting to fill Pregerson's. But the Ninth Circuit would be 16-13 R/D if they didn't trade. That's a huge shift they might not be willing or able to pass up.

The R/D is the other way, but the point holds. But it's all moot anyway; McConnell refuses to get rid of 30 hours, and, given the pressure that creates to triage, he's decided already-red circuits take priority.

I wonder how long McConnell will stand by the 30-hour rule as to nominations. We can't wait 11 years to have all the nominees confirmed (see http://bit.ly/2GWHd3H ).

My guess is that we start to see nominations strung together keeping the senate in session. Especially as we get close to Election Day and vulnerable D senators need to get home.

But, how liberal? I can imagine Grassley helping Feinstein if she puts it atop her "Chuck, this is really important to me" list. Plus, if he thinks her seat will remain D no matter what, helping her on this can help her reelection. (Else Whitehouse becomes ranking or chair?)

I feel like until (if) McGahn leaves, the WH will be hard to negotiate with in the eyes of Feinstein or Harris. Maybe they will pick an older, conservative jurist, like you mentioned with the case of Carlos Bea, and then pick two youngish judges for the others (perhaps Rogan)?

And If the WH convinces Bea and Milan Smith to go senior, then all 5 of the candidates mentioned in
@Zoetillman's article could be picked. I doubt the WH would give up a seat, as there are more vacancies on the court right now than seats Obama filled. 1/2 -
Trump would love to brag about having more 9th Circuit appointees than Obama, so I really think this is going to be all about how much Feinstein and Harris are willing to give up.
