Agreed. Or at least, encourages it.

People can commit bad acts/act badly, but speaking for myself, I don’t like to brand people “bad human beings.” I’m not perfect and it’s not my place to judge.

As I’ve said before, I didn’t know any details (as opposed to vague rumors) until the
@washingtonpost stories (& former clerks rebuffed my efforts to get such details).3 replies 0 retweets 1 like -

But...your fictionalized Judge Kozinski was basically a sexual harasser par excellence, right? You said you didn’t defame anyone in writing the book and the behavior you describe is pretty outrageous. Presumably that was based on something?

Oh goodness, I have a lot to say, & at some point I will say it in full. But for the time being: 1. This post by
@PeterContiBrown is very insightful: http://yalejreg.com/nc/revisiting-david-lats-supreme-ambitions-in-light-of-the-kozinski-scandal/ …#SCOTUS#AppellateTwitter2 replies 2 retweets 4 likes -

2. I had no clue about all the allegations that would later emerge, but like many, I had heard inchoate rumors; I took these rumors & fictionalized heavily, as novelists do; little did I know that life might imitate art.

3. The Polanski character’s actions fall well short of the allegations - Audrey even finds him “charming” - but the ending (pp. 280-81) hints that there could be more below the surface.

4. But again, I had no clue my “prediction” would come to pass - just like the death in the book of a brilliant, fiery conservative
#SCOTUS justice, at age 79, predeceasing an older, liberal, cancer-surviving female colleague.1 reply 0 retweets 2 likes -

5. But now, as
@AppellateDaily suggested the other day, I might have more material for a sequel, this time taking place at#SCOTUS....pic.twitter.com/a80GkCVTi6

6. The theme I had in mind for the sequel (well before recent events): human beings are complicated creatures, and a “hero” in one context can be a “villain” in another (& vice versa - I was actually planning to redeem the Stinson character).

7. The Audrey character - who’s a stand-in for me, as I’ve said before- is a bit naive. And maybe so was I.
