@DavidLat @adamliptak vast majority of unpub decisions (at least @ Ninth when I clerked) were appropriate but it is a place to hide as well.

@DavidLat@adamliptak there are so many cases that simply fail to meet one of the various heightened standards of review. -
@DavidLat@adamliptak my impression was that almost every case that took more than three pages to explain the ruling should be published. -
@brendanistan@adamliptak Well, there are some cases that raise many meritless issues that take more than 3 pages just to describe. -
@DavidLat@adamliptak yeah, those are the exceptions. we had one that was basically ten pages of reciting each issue and saying no to each.
