16/ Key missing piece is Kavanaugh’s odd #KlaymanOpinion about 215, PRISM. In that surprising opinion, Kavanaugh justifies warrantless surveillance. (1) Kavanaugh said ‘no search’ (citing Smith v. Maryland) and (2) ’if search, then still ok’ (citing ‘special needs’ doctrine)pic.twitter.com/2W9gupUxVd

17/ Smith v. Maryland is overturned in Carpenter. And even @OrinKerr surprised by "Special Needs" analysis - http://www.scotusblog.com/2018/07/judge-kavanaugh-on-the-fourth-amendment/ …)pic.twitter.com/SEFISClqi5

18/ @SenatorLeahy asked Kavanaugh about #KlaymanOpinion last week. (Worth watching closely). https://www.c-span.org/video/?c4748241/senator-leahy-pursues-questions-privacy-judge-kavanaugh …pic.twitter.com/am8i5MEMXl

19/ @SenatorLeahy points out @PCLOB_GOV found no support for record collection program. Did not prevent terrorist acts. (Same finding in 4 @senjudiciary hearings). @SenatorLeahy also raises Carpenter https://www.pclob.gov/library/215-Report_on_the_Telephone_Records_Program.pdf …pic.twitter.com/Tme4NMw6dp

20/ Kavanaugh says Carpenter is “game changer,” but side steps second part of question — his defense of mass surveillance in Klayman, the legal rational for Stellar Wind and 215 secret expansion.

21/ Four problems with nominee for those who care about future of privacy. (1) @WhiteHouse role in promotion of #PatriotAct and defense of #WarrantlessWiretapping. (2) Ongoing secrecy about involvement in other related programs. . . .

22/ . . . (3) Radical opinion in #Klayman that ‘special needs’ justifies suspicionless surveillance of Americans. (4) Use of judicial office to defend prior acts in White House

23/ Recall - #WarrantlessWireapping program was suspended when made public in 2007. Broad use of section 215 was reversed by Congress in June 2015. #FreedomAct

24/ But in late 2015 after #FreedomAct enacted, #Kavanaugh justified mass surveillance in odd opinion that was unexpected, unsupported (contradicted by fact), and contrary to well established precedent. #SCOTUS

25/ Last thought - future of privacy in America is not a D or R issue. It should concern all Americans, all members of @senjudiciary, @SenateGOP, @SenateDems. Our Constitutional traditions reject suspicionless surveillance. Will the nominee?

      Replying to @MarcRotenberg @senjudiciary and

Thanks for these thoughts on some important issues. I know @RandPaul was concerned about Kavanaugh's views on privacy and Klayman, although Paul did come around based on a holistic review. I am curious - is there a Trump #SCOTUS shortlister you like better?

Question now before @senjudiciary is whether to proceed with vote on #Kavanaugh Much more needs to be known about his role in surveillance programs - which @senjudicary itself opposed. #WarrantessWiretapping #FreedomAct #WhatAreTheyHiding #PostponeTheVote
