He told Senator Kennedy under oath that he never saw any stolen material. We now know that wasn't true. What you are missing is that Kavanaugh *also* had the benefit of hindsight when he made that false statement.

Yes. Because it's a lawyer's job is to be far more assured with information, documents, etc. Having been involved in the upper echelon of the legal profession for years I know how lawyers will literally sweat words like "the" in a document.
