I don't want to twitter-pick (and I know you didn't mean it this way!), but I kind of cringe at being described as "not a Kozinski fan." I (obviously) believe (and have said publicly) that Judge Kozinski behaved inappropriately.

But I don't think it is or should be about whether you are a fan of someone personally (or even professionally), in the sense of “what they do outside of sexually harass people.”

I think that mindset makes it harder to speak up against people who you think do good in the world (as many people do, and as Judge Kozinski did too, particularly on issues like Brady v. maryland).

I think it is unfortunate there was never an investigation. I also don’t think a confirmation hearing is a substitute for an investigation, given the enormous stakes of the nominee’s views on other issues.

I think Senator Hirono was asking about an important issue. I think she was limited in the effectiveness of her questions given that the nominee (as all nominees do) had things he wanted to say rather than responding directly to her questions.

But I agree the questions and follow up could have been a lot better on this issue and others.

I definitely did not think you were using it in any kind of impliedly bad way, I just wanted to flag it since this issue is one that I've thought a lot about!
