I "retract" this tweet, based in part on my misunderstanding of #Senate procedure (which @StevenJDuffield clarified), but adhere to my view that Ryan Bounds was smeared (& I'm working on a detailed analysis of his old college op-eds to show he's no racist).https://twitter.com/DavidLat/status/1020033573276078080 …

I would say zero chance. He has already been tarred and feathered as a racist. The decision by Scott and Rubio to not support the nom. has validated that ugly smear in many people’s eyes. I am still confused as to why their concerns were not addressed earlier in the process.

It’s mind-boggling how this was raised at the last minute. Also, this can have very serious detrimental effects on Bounds’ career and life. It’s very sad for him and the country. A complete disgrace.

The smearing of Bounds as a racist makes me believe that the federal judiciary is going to lose a lot of fantastic candidates for judges.

The politicization of the process is turning off many legal eagles. Someone like me (whose dream it is to be a circuit judge) are thinking twice about it. I don’t want to be smeared as a partisan hack or worse, a racist. It’s a very sad state in judicial politics.

If you harbor dreams of a federal judgeship, my respectful advice would be to get off twitter.

Agreed. Here's my latest, noting the chilling effect this will have:http://bit.ly/2mxIqFc
