        This is a great breakdown, thank you. One point I’d disagree on... the politicization of the confirmation process goes back to Bork, no? Decades before Merrick Garland.

        True, but they did confirm Kennedy after that, whereas Garland was a non-starter. the refusal even to consider the president's nominee ushered in a new era.

        Ranking "brilliance" is nonsensical. By what measure? In any case, it's irrelevant. The justices don't decide cases based on the depths of their understanding of the law.
