The attacks on Kavanaugh are as silly as they are groundless. We shouldn’t have litmus tests for results in O’Care or abortion cases. It’s maddening from the perspective of an originalist like myself. We need impartial, independent and outstanding jurists.

This is simply false. He outlined his issues with the constitutionality of O’Care without deciding the merits. The notion that he has to circumvent judicial procedures to invalidate laws is ridiculous and wrong.

As an originalist, I don’t care about “headlines.” I care about someone who will apply the original meaning of the constitution and text of the laws impartially. And so much for the mindless banter of “Stare Decisis” when there was no precedent on the books for O’Care at the time

There is a precedent, it's called the Power to Tax Clause and he ducked it. There is also another precedent, called the 10th Amendment, and he let that one slide too.
