    Btw, if I am not missing something here, this would be THE weirdest example of why creating an adjustment provision outside of 245 is gonna lead to weird results. Though I have been pointed to other examples, none of them included derivative style options.

    Does this mean you can fille a I485 from Liberia? If not? Why not? This weirdness came up at the CLE today, and I could not then, and cannot now come up with a reason why you couldnt that isnt rooted in 245. But the LRIF doesnt use 245, so 🤷‍♂️

    LRIFA nerds: the text of LRIF requires the adjustment of qualified applicants, including nationals of Liberia continously present in the US since 2014, and the spouse and child of those who meet the above criteria. It does not require the spouse or child to be present.

    At 8pm I had a half finished CLE slidedeck for tomorrow. I was like, "cool, I'll get buried in INA analysis and powerpoint styles for a couple of hours instead of refreshing twitter for latest vote counts. Then when I'm done, I'll just check who won." Ummm...I'm done?

    Meaning, that someone who is ineligible for adjustment due to being a USC for example, or a aggravated felon, does not preclude their spouse or kids from applying. But, no derivative beneficiaries means no consular processed following to join petitions.

    Oh also "derivatives" are strange too. There is actually no derivative applications. Instead there are the applicants which have to prove eligibility by nationality and residence requirements, and those who have to prove eligibility by being a relative.

    On the other hand marriage fraud findings under 204(c) don't say you are "ineligible for a immigrant visa" they merely say that you cannot be approved for a visa under the specific provisions of the act applying to IR and Preference category petitions. So maybe LRIF works?

    Failure to comply with the 2 year foreign residency requirement makes you statutorily ineligible for an immigrant visa unless waived. (which is the only way I've found where that provision is separate from admissibility).

    However, say you are inadmissible under the smuggling ground for bringing in your kids EWI 20 years back. No big deal, you can get a pretty low standard waiver. Except, wait, the waiver only applies to IR petitions or preference category petitions. No waiver.

    Like lets just take for example the example of someone who fails to depart on VD. Barred from adjustment right? Well, you'd think that, but because the bar says cannot get relief under 8 USC 1225 of the act, then it doesn't bar adjustment under LRIF.

    I am teaching a CLE on the Liberian Refugee Immigration Fairness Act tomorrow and finishing up the reaseach tonight (cause of course). However, I think its kinda unappreciated how much weirdness is caused by making a whole adjustment section outside of the confines of INA 245.
