But if the constraint placed by the judge is a good explanation, would it matter that the source of the error correction is not the ministers but the judges

Nothing in the world matters more. Ministers are peacefully removable by elections. Judges aren't.
The answer is the same as if you had asked the same question about the King, the Pope, or any other alternative to elections.
