Apple keeps doubling down on we only shake down 16% of businesses on the App Store is truly a bizarre argument. It's in direct refutation that it treats all developers the same. If they were, there'd be one fixed price that all developers would pay. OH WAIT, THERE IS! $99/yr!

Nadler asks about
@heyhey! Cook is "happy that they're there".. haha. So fucking happy, eh? That we were within an inch of getting destroyed by your shakedown tactics. Then pivoting to WE ARE JOB CREATORS. Cook is really putting on the clown show right now.3 replies 10 retweets 100 likesShow this thread -
He also misrepresented the concessions they forced us to make. Saying we weren't paying any cut on the "free version" they bullied us into providing, implying that we still were paying on the rest of the business. We're not. Because we stood our ground.

Infuriating to hear Cook justify his extortion racket by pointing out that once upon a time, someone might have paid a software retailer 50% of revenues. Basecamp has been around since 2004. We've never paid anyone more than the low single-digit CC rates. So this is bunk.

Cook continues to represent that prior to the App Store, software makers couldn't sell their goods except through other extortive channels, and it's just categorically false. Basecamp was thriving well before 2008. The App Store has done nothing for our business.

Because it doesn't bring us any business! Just like is true for the vast, vast majority of other software makers in the App Store. Apple shines their top chart/highlight cone on a vanishingly small number of makers. Everyone else has to do their own marketing work. We do!

If we could distribute software to iPhone users without going through the App Store, we absolutely would! Just like we do on the Mac. We don't need Apple's extortive bargain, but there's no option to refuse! Tying distribution to marketing is bunk and should be illegal.

Cook is so fucking proud that the App Store discriminates in such a way that only 16% of developers have to fund the show. This is not a good argument?? We only squeeze and discriminate and shake down 16% of makers!! This is a shitty argument!

"There are enormous choices out there!", Cook is back to telling us that we should write email services for PlayStation. What a terrible argument too. It's like Google saying Travelocity is a competitor when the internet gatekeeper problem is raised.

Remember when Netflix defined its competition as sleep? This is basically that playbook. Just define the competition impossibly broadly, and it looks like you have no domination. Like Amazon does with ALL OF RETAIL vs online sales.
