Argument: mandatory school during a pandemic is cruel and unusual punishment, for the children, teachers, and parents. Unconstitutional. We gotta figure out something else to do for the kids!

I see the connection though. It is normally one of the rights of the accused BUT it does protect us from cruel and unusual punishment. I can make a few solid arguments that traditional school is just that with or without COVID

I think that the argument is that *truancy* can't be prosecuted without it being cruel and unusual punishment because *either* going to school or jail or rehabilitation facilities are a risk to their person and also their family.
