Someone rightfully pointed out that they explicitly ask, in the ToS, the right to analyze the code for the benefits of their own services... "This license includes the right to do things like [...] parse it into a search index or otherwise analyze it on our servers [...]"

putting something in a ToS nobody actually reads is *implicit* consent, not *explicit* but yes, just another reason to #DeleteGithub

They have tiny font at the bottom of the sign up page saying that it's implied you agree to their terms of service if you sign up. I don't think they even have people check a box saying they agree to it. It's hard to see how that can be considered a contract at all.
