Why is the eviction moratorium constitutional, I asked the president. Biden told me "I can't guarantee you the court won’t rule that we don't have that authority but at least we'll have the ability to, if we have to appeal, to keep this going for a month-at least. I hope longer."

Small property owners/landlords "hanging on by their fingernails" as eviction moratorium drags on, federal relief slow to arrive. It's a "version of slavery ... forcing people to work and produce a product for free, and there’s no compensation.”

So Biden basically admitted his rent moratorium was unconstitutional. But — again, by his own admission — he shopped for some lawyers who’d say it isn’t. This is a violation of the President’s oath of office. Constitutional norms aren’t just for the other team.

This press conference and the report are way, way, way more detailed and damning that many in press and among Dem operatives expected. What happens now is unclear - ball is in Heastie's court.
