Was part of a hearing where a poor performing black employee had his cell phone taken away for misuse and won his EEOC hearing on the sole reasoning he was the only black employee in his section and some of his negative performance points weren't documented

I only have tangential relations with employment law but the massive HR structure at major companies is to mediate this sort of thing
