"The sovereign decides the exception" isn't quite "the rule of law is a theoretical impossibility" (although it is under the current system). The level of rule of law that's optimal is far higher than what we currently have.

Yeah, rule of law exists as a moral principle in the minds of decision-makers, & to the extent that they hold themselves/each other to it, it's real But there's really nothing to stop them ignoring it I used to believe systems could hold them accountable to the law

>I used to believe systems could hold them accountable to the law Oh yeah, that one is false for sure. Rule of law is good, in the long run you need a king to get it because only a king has aligned incentives. In the medium term only virtuous elites can ignore incentives.

Most people actively focused on identifying what society approves/disapproves, so they can get rewarded for obedience. Over time elite entry criteria changes from imperfectly measured virtue - as measured by whatever idiosyncratic method used by that elite - to directly pinning the needle on the measurements. Goodhart's law and the fall of civilizations.
