"The sovereign decides the exception" isn't quite "the rule of law is a theoretical impossibility" (although it is under the current system). The level of rule of law that's optimal is far higher than what we currently have.

Yeah, rule of law exists as a moral principle in the minds of decision-makers, & to the extent that they hold themselves/each other to it, it's real But there's really nothing to stop them ignoring it I used to believe systems could hold them accountable to the law

right, that's the reason the USA lasted as long as it did, not separation of power but balance of power - the states automatically held power, the branches of government did too, progressively losing that balance through Lincoln and FDR to today.

Hard to argue with that. The central power held a Schelling point by being the highest quality power center and used that to grind out all the rival power centers. As that need dissipated, the central power worsened in quality.
