We're getting out of the thought experiment territory here but a smuggler is a man who bargains for protection from the powerful men that he's serving as a valued market maker for - both his buyers and suppliers want him alive He recognizes their property rights and is protected

That situation is one where there are competing primary property holders (i.e., state-like actors) - he gets to keep his secondary property because it's in the best interest of a primary property holder that he does so and that primary property holder protects him from rivals.
