twitter and facebook don't need or want a regulatory moat since they benefit from network effects while a regulatory moat eventually eats all the profits it guards because (you guessed it) principal / agent problems in manipulating the regulators.

twitter and facebook do not depend at all on IP protection. The only thing you could do with their IP would be make an alternative client and they could simply respond by ... changing some protocols to break your client. Facebook does rely on their data not being stolen.
