That's not even really an "or" - that's what they believe but don't want to admit openly or even to themselves. Same with Zimmerman / Martin - they won't state it openly but the only abstract rule that lets you come to their conclusion is that Martin had a right to murder Z

Yes, but they believe this on an exception by exception basis. Every *particular* example is unjustified rather than them admitting that they have a rule that covers all cases.
