Eggshell skull rule - someone is responsible because the military decided that this rule applies. Of course the reason that rule applies is specifically to harm military readiness and good order (which is why Jessup preserving himself is important)

The hidden part is that that's the actual enemy that Jessup is fighting and Jessup is no longer the villain if you see him as preserving a more valuable military asset against that adversary. Being expended in a fight against the enemy is one of things they signed up for.
