You first statement is generally true -double homicide on a city street is almost always charged, even if gets off later. Your second statement is also true - cities have been derelict in letting these riots go on. What part of (2) changes (1)?

The line you think is so clear is entirely made up. You don't *have to* charge someone when it's clear and obvious self-defense and you don't have to charge anyone for burning down and sacking a city. Your made up principle is a way of avoiding seeing that it's purely who/whom.
