How does the accusations that he conspired to hack the US Military have anything to do with journalism? Do journalists get a pass for hacking?
Journalists claim they do Or is there supposed to be some difference between "publishes what someone hands us" and "goes out and accesses information" other than laziness and incompetence at the latter task?

I'm not aware of any journalists claiming they can actively go out and hack US Government databases. Nor am I aware if any making the case that they can conspire to do so. Legally, there is a major difference here. Let's examine from another perspective. 1/

Suppose you are a police officer. A civilian comes into evidence of a crime illegally. They weren't directed to find that evidence. It just happened as part of another circumstance. This can be used in court of they hand the evidence over to police. 2/
